1. Acceptance of Terms

By visiting, viewing, accessing, or otherwise using the website Handsgram and any services created, collected, or submitted to it (including uploading photos, creating pages, or sharing other media), you agree to be bound by the following Terms and Conditions of Service. If you do not wish to be bound by our Terms, your only option is not to visit, view, or otherwise use the services of Handsgram. You understand and agree that these Terms constitute a legally binding agreement between you and Handsgram, and that your use of the platform indicates your conclusive acceptance of this agreement.

2. User Accounts, Passwords, and Security

To access certain features of the website, including uploading content or creating celebrity pages, you may be required to log in via email or third-party providers.

• You are entirely responsible for maintaining the confidentiality of your account credentials.
• You agree to notify Handsgram immediately of any unauthorized use of your account or any other breach of security.
• Handsgram cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

3. User-Generated Content (UGC) & Responsibility

• Content Responsibility: You understand that all photos, images, text, or other materials (collectively, "Content") uploaded to Handsgram are the sole responsibility of the person from whom such Content originated. Handsgram may, but is not obligated to, pre-screen, monitor, verify, or endorse user-uploaded content for accuracy, legality, or safety.
• Representations and Warranties: By uploading any photo or Content, you represent and warrant that you own all copyrights, trademarks, and publicity rights, or have obtained all necessary licenses and permissions from the rightful owner(s) to share and publish the Content. You agree not to upload any Content that infringes upon the intellectual property rights or privacy rights of any third party (e.g., photos of individuals without their explicit consent).
• Prohibited Content & Conduct: You are strictly prohibited from uploading any Content or taking any action on the site that is pornographic, obscene, violent, hateful, defamatory, harassing, or otherwise illegal. You may not use automated systems (bots, scrapers, spiders) to harvest data or content from Handsgram. Handsgram reserves the right, at its sole discretion, to remove any Content and suspend or terminate user accounts that violate these rules without prior notice.

4. User Content License

When you submit or upload photos/Content to Handsgram, you simultaneously grant Handsgram a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and non-exclusive license to host, store, use, display, reproduce, modify, adapt, distribute, and publish your Content across any digital media or marketing channels for the purpose of operating, promoting, and improving the platform.

5. Cached Copies, Backups & Re-Uploads

You acknowledge and agree that removed or deleted Content may continue to exist for a limited period of time in backups, cached pages, archival systems, or other technical storage mechanisms. Additionally, Handsgram cannot prevent other users or third parties from saving, copying, screenshotting, re-uploading, or redistributing Content that has previously been made publicly available on the platform.

6. Celebrity Pages and Community Guidelines

Handsgram allows users to create pages dedicated to public figures and celebrities. You agree to use discretion and respect the boundaries of these individuals when creating pages. If a celebrity or their authorized legal representative requests the removal of their page or specific content associated with them, Handsgram reserves the right to remove such pages or content immediately, without prior notice to the user who created it.

7. Age Restriction

You must be at least 18 years old, or the minimum legal age required in your jurisdiction, to use Handsgram. By using the platform, you represent and warrant that you meet the applicable age requirements. Handsgram does not knowingly collect or solicit personal information from children under the applicable minimum age.

8. Privacy Policy Reference

Please review our Privacy Policy to understand how we collect, use, store, and protect your personal information and uploaded Content. By using Handsgram, you also agree to the practices described in our Privacy Policy.

9. Copyright Policy & "Take-Down" Procedure (DMCA)

Handsgram respects the intellectual property rights of others. If you believe that your copyrighted work, trademark, or personal rights have been infringed upon by Content hosted on our platform, please notify us immediately at [email protected]. Upon receipt of a valid and detailed notice, Handsgram will act swiftly under the "Notice and Take-Down" principle to remove or disable access to the allegedly infringing material.

10. Indemnification

You agree to indemnify, defend, and hold harmless Handsgram, its subsidiaries, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights, including copyright, trademark, privacy, or property rights.

11. Disclaimer of Warranties

You expressly understand and agree that your use of Handsgram is entirely at your own risk. Our services are provided on an "As Is" and "As Available" basis. Handsgram does not make any express or implied warranties, endorsements, or representations whatsoever as to the operation of the website, information, content, materials, or products. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that access to the service will be uninterrupted, secure, or error-free. Handsgram is not responsible for the deletion, corruption, or failure to store any photo or content uploaded by users. You are solely responsible for backing up your data.

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Handsgram, its subsidiaries, affiliates, directors, or employees be liable for any direct, indirect, incidental, consequential, special, or exemplary damages. This shall include, but not be limited to, damages for loss of profits, business interruption, loss of data, loss of programs, or other intangible losses arising out of the use of or the inability to use the service, or the actions/content of any third-party users. The above limitation shall apply whether or not Handsgram has been advised of or should have been aware of the possibility of such damages.

13. Modification and Termination of Services

Handsgram reserves the right at any time, at its sole discretion and without notice, to modify, improve, suspend, or permanently discontinue any of its services, features, or parts of the website. Your account may be terminated or suspended at any time, for any reason, without liability to you.

14. Changes to the Terms

Handsgram reserves the right to modify these Terms from time to time at our sole discretion and without any prior notice. Changes to our Terms become effective on the date they are posted on this page. Your continued use of Handsgram after any changes will signify your agreement to be bound by the updated Terms.

15. Governing Law & Jurisdiction

You expressly understand and agree to submit to the personal and exclusive jurisdiction of the courts of the country, state, or territory determined solely by Handsgram to resolve any legal matter arising from this agreement or related to your use of the website. If any provision of this agreement is found invalid by a court of law, that provision will be removed, and the remaining Terms will continue to be valid and enforceable.
